Proslijeđivanje pitanja od strane drugih sudova – nedovoljno iskorištena nadležnost ustavnog suda BiH

SUMMARY
Prosljeđivanje pitanja od strane drugih sudova Ustavnom sudu BiH predstavlja jednu od osnovnih nadležnosti Ustavnog suda BiH utvrđenu članom VI.3.c Ustava Bosne i Hercegovine. U skladu sa navedenim članom Ustava, Ustavni sud Bosne i Hercegovine je nadležan u pitanjima koja mu je proslijedio bilo koji sud u Bosni i Hercegovini u pogledu toga da li je zakon, o čijem važenju njegova odluka ovisi kompatibilan sa Ustavom, sa Evropskom konvencijom o ljudskim pravima i slobodama i njenim protokolima, ili sa zakonima Bosne i Hercegovine ili u pogledu postojanja ili domašaja nekog općeg pravila međunarodnog javnog prava koje je bitno za odluku suda. Uvođenjem ove nadležnosti Bosna i Hercegovina se pridružila krugu zemalja koje svom ustavnom sudstvu dodjeljuju i dodatnu mogućnost kontrole ustavnosti i zakonitosti koja se može vršiti ne samo in apstracto već i povodom konkretnog spora koji se javi pred nadležnim redovnim sudom. S obzirom da se radi o jednoj specifičnoj funkciji Ustavnog suda BiH koja nije u dovoljnoj mjeri definisana ni samim Ustavom BiH niti Pravilima Ustavnog suda BiH u nastavku rada će nakon analize normativnih rješenja kojim se reguliše navedena nadležnost Ustavnog suda BiH biti analizirana i dosadašnja jurisprudencija Ustavnog suda BiH u ovoj nadležnosti u cilju utvrđivanja osobenosti ovog vida kontrole ustavnosti i zakonitosti u bosanskohercegovačkom ustavnom sistemu.
ABSTRACT
Referral of questions by other courts to the Constitutional Court of BiH is one of the basic competencies of the Constitutional Court of BiH as defined in Article VI.3.c of the Constitution of Bosnia and Herzegovina. In accordance with the aforementioned Article of the Constitution, the Constitutional Court of Bosnia and Herzegovina is competent in matters which have been transmitted to the Constitutional Court of BiH by any court in Bosnia and Herzegovina as to whether the law, whose validity is dependent on the Constitution, is compatible with the European Convention on Human Rights and Fundamental Freedoms and its protocols, or with the laws of Bosnia and Herzegovina, or with regard to the existence or the scope of a general rule of international public law which is relevant to the decision of the court. By introducing this jurisdiction, Bosnia and Herzegovina has joined a circle of countries that assign to its constitutional judiciary an additional possibility of controlling the constitutionality and legality that can be exercised not only in abstracto but also in the context of a specific dispute before the competent regular court. Considering that this is a specific function of the Constitutional Court of BiH that is not sufficiently defined by the BiH Constitution itself or the Rules of the Constitutional Court of BiH, in this paper, after the analysis of the normative ruling regulating the stated competence of the Constitutional Court of BiH, will be analyzed and the existing jurisprudence of the Constitutional Court BiH in this jurisdiction in order to determine the peculiarities of this type of control of constitutionality and legality in the BosnianHerzegovinian constitutional system.
